Terms of Service

Effective Date: July 6, 2026

These Terms of Service ("Terms") govern the services provided by Equilibrium Consulting LLC ("EQC"), operating as The Realtor's Handymanâ„¢. By scheduling an assessment, approving an estimate, or authorizing work, the Client agrees to these Terms.

1. Scope of Services
EQC provides transaction readiness, property make-ready, maintenance, repair, and related consulting services for residential properties.

 

Services are performed only as described in the approved estimate or written work authorization.

 

Any work requested outside the approved scope may require a revised estimate or change order.

2. Service Area
EQC provides services within its published service area.

 

Projects outside the normal service area may incur additional travel charges or may be declined.

3. Property Assessments
Property Assessments are a professional service intended to identify maintenance concerns, deferred maintenance, transaction readiness issues, and recommended corrective actions.

 

Assessment fees are:

• due at the time of scheduling,

• non-refundable once the assessment has begun,

• separate from any future repair work unless otherwise stated in writing.

 

Payment for an assessment does not guarantee repair scheduling or project acceptance.

4. Estimates
Estimates are based on the information available at the time they are prepared.

 

Unless otherwise stated:

• estimates are valid for 14 calendar days;

• pricing may change if project scope changes;

• concealed damage or previously unknown conditions may require additional work and revised pricing.

 

No work begins until the estimate has been approved.

5. Deposits
EQC may require a deposit before scheduling repair work.

 

Generally:

 

• small projects may not require a deposit;

• larger projects requiring significant labor or material purchases may require a deposit before scheduling;

• custom-order materials must be paid for in advance.

 

Required deposits are identified on the approved estimate.

6. Payment Terms
Unless otherwise agreed in writing:

​

• Property Assessments are paid when scheduled.

• Standard repair invoices are due upon completion of work.

• Qualified brokerage firms and property management companies may be approved for Net 10 payment terms after establishing a satisfactory payment history.

• EQC does not offer Net 30 payment terms as a standard business practice.

 

Payment is not contingent upon the sale, financing, refinancing, lease, or closing of any real estate transaction.

7. Accepted Payment Methods
EQC accepts approved electronic payment methods as listed on invoices.

 

Returned payments, declined transactions, or insufficient funds may incur additional fees.

8. Late Payments
Invoices not paid according to the agreed payment terms may be subject to:

​

• late payment fees,

• collection costs,

• suspension of future services.

 

EQC reserves the right to refuse additional work until outstanding balances have been satisfied.

9. Change Orders
Additional work requested after a project begins is not included in the original estimate unless specifically stated.

 

Changes in scope may affect:

​

• pricing,

• schedule,

• completion date.

 

Additional work must be approved before it is performed.

10. Scheduling
Appointment times are scheduled in advance.

 

While EQC makes every effort to arrive as scheduled, arrival times may be affected by:

​

• previous projects,

• weather,

• material availability,

• emergencies,

• circumstances outside EQC's control.

 

Clients will be notified whenever practical.

11. Client Responsibilities


The Client agrees to:

 

• provide safe access to the property;

• ensure utilities are operational unless otherwise disclosed;

• secure pets; disclose known hazards or property conditions;

• provide any required homeowner or HOA approvals.

• provide at least 24 hours of notice to reschedule any set service or appointment

 

Delays caused by lack of access may require rescheduling.

12. Materials
Unless otherwise agreed:

 

• EQC supplies standard installation materials.

• Specialty materials requested by the Client may require advance payment.

• Material availability may affect scheduling.

 

EQC is not responsible for manufacturer delays or discontinued products. All product guarantees and warranties are between the Client and the manufacturer.

13. Existing Conditions
Residential properties often contain concealed conditions that cannot be identified until work begins.

 

Examples include:

 

• hidden water damage;

• structural deterioration;

• improper previous repairs;

• code violations;

• concealed plumbing or electrical issues.

 

Discovery of concealed conditions may require revised estimates before work continues.

14. Permits and Licensed Trades
EQC performs only work permitted under applicable Tennessee law.

 

Where required, EQC may recommend or coordinate with appropriately licensed contractors for services including, but not limited to:

 

 • electrical;

• plumbing;

• HVAC;

• roofing;

• specialty trades.

 

Clients remain responsible for permit requirements unless otherwise agreed in writing.

15. Workmanship Warranty
EQC stands behind its workmanship.

 

Unless otherwise stated:

​

• workmanship is warranted for one hundred and eighty (180) days from the date of completion.

 

This warranty covers defects resulting directly from EQC's workmanship.

 

The warranty does not cover:

​

• normal wear and tear;

• abuse;

• misuse;

• neglect;

• acts of nature;

• acts of war or terror;

• manufacturer defects;

• movement of the structure;

• work altered by others after completion.

 

Manufacturer warranties remain the responsibility of the product manufacturer.

16. Limitations of Assessments
Property Assessments are visual, non-invasive evaluations.

 

They are not:

 

• home inspections;

• engineering reports;

• code compliance inspections;

• structural certifications;

• mold, environmental, or pest inspections.

 

Clients requiring these services should retain appropriately licensed professionals.

17. Photographs
EQC may photograph work areas for:

 

• project documentation;

• quality assurance;

• warranty administration;

• training;

• marketing purposes.

 

No personal identifying information will be intentionally disclosed.

 

Clients may request in writing that photographs not be used for marketing.

18. Limitation of Liability
To the fullest extent permitted by law:

 

• EQC's liability shall not exceed the amount paid for the specific service.

• EQC shall not be liable for indirect, incidental, special, or consequential damages.

19. Force Majeure
EQC shall not be liable for delays or inability to perform resulting from circumstances beyond reasonable control, including: 

 

• severe weather;

• natural disasters;

• supply chain disruptions;

• labor shortages;

• government actions;

• utility outages;

• acts of war or terror;

• emergencies.

20. Governing Law
These Terms shall be governed by the laws of the State of Tennessee.

 

Any legal action shall be brought in a court of competent jurisdiction located within the State of Tennessee.

21. Changes to These Terms
EQC reserves the right to modify these Terms at any time.

 

The version published on the EQC website shall govern future services unless otherwise agreed in writing.
